Terms of Service

1. Agreement to Terms

By accessing or using Kept ("Service"), you agree to be bound by these Terms of Service. If you disagree with any part of the terms, you may not access the Service.

2. Description of Service

Kept is a link-in-bio platform that allows users to create a personalized page with links, collect email subscribers, and monetize their audience through tips and digital products. We offer both free and paid subscription tiers.

3. User Accounts

To use certain features, you must create an account. You are responsible for:

  • Maintaining the security of your account and password
  • All activities that occur under your account
  • Ensuring your account information is accurate and current

You must be at least 18 years old to create an account. Usernames are provided on a first-come, first-served basis. We reserve the right to reclaim usernames that violate trademarks or are inactive for extended periods.

4. Acceptable Use

You agree not to use Kept to:

  • Violate any laws or regulations
  • Infringe on intellectual property rights
  • Distribute malware, spam, or harmful content
  • Harass, abuse, or harm others
  • Impersonate others or misrepresent your identity
  • Sell or promote illegal goods or services
  • Collect user data without consent
  • Interfere with or disrupt the Service

We reserve the right to suspend or terminate accounts that violate these terms.

5. Content Ownership

Your Content: You retain ownership of all content you create on Kept. By posting content, you grant us a non-exclusive license to display, distribute, and promote your content as part of the Service.

Our Content: Kept and its original content, features, and functionality are owned by us and protected by copyright, trademark, and other intellectual property laws.

6. Payments and Fees

Subscriptions: Pro subscriptions are billed monthly. You can cancel anytime, and your subscription will remain active until the end of the billing period.

Platform Fees: Free tier users are subject to a 5% platform fee on tips and digital product sales. Pro users pay 0% platform fees. Stripe payment processing fees apply to all transactions.

Payouts: Creator earnings are paid out via Stripe Connect. You are responsible for any applicable taxes on your earnings.

Refunds: Subscription refunds are handled on a case-by-case basis. Digital product refunds are the responsibility of the creator.

7. Subscriber Data

Email addresses collected through your Kept page belong to you. You can export your subscriber list at any time. You are responsible for complying with applicable email marketing laws (CAN-SPAM, GDPR) when contacting your subscribers.

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. We may modify, suspend, or discontinue features with reasonable notice. We are not liable for any downtime or service interruptions.

9. Limitation of Liability

To the maximum extent permitted by law, Kept shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill. Our total liability shall not exceed the amount you paid us in the past 12 months.

10. Indemnification

You agree to indemnify and hold harmless Kept and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes via email or through the Service. Continued use after changes constitutes acceptance of the new Terms.

12. Termination

You may delete your account at any time. We may terminate or suspend your account immediately for violations of these Terms. Upon termination, your right to use the Service ceases, but provisions that should survive (ownership, liability, indemnification) will remain in effect.

13. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Delaware.
